General Terms and Conditions
General, Scope of Application
These general terms and conditions (GTC) apply to all our deliveries and services between Tropical Mountains GmbH (hereinafter referred to as Tropical Mountains) and our customers in the respective version valid at the time of the conclusion of the contract. Deviating terms and conditions of the customer are only valid if expressly accepted by Tropical Mountains in writing in each individual case.
Registration
The data required by the customer for a registration or respective order must be provided completely and correctly. If, after registration or order, a change occurs in the data provided, the orderer is obligated to correct the information without delay.
A personal password chosen by the customer when registering on the Internet must be kept secret and may not be made accessible to third parties. The orderer is responsible for all actions that are made under the password on the Internet site.

Conclusion of the contract
The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog. The order is placed at the prices and information given on the day of the order. Your order in our online store constitutes an offer to us to conclude a purchase contract. Tropical Mountains will inform you about the receipt of your order including the details of the order with an "order receipt confirmation" by email immediately after receipt of the order. This order confirmation does not constitute a purchase contract, it is only for your information and control. The acceptance of the offer by Tropical Mountains takes place after checking the order by sending the ordered goods. If the goods are not available at short notice, the buyer will be informed by email. A new delivery date will be agreed upon or the buyer can withdraw from the purchase and the payment will be refunded.
Payment
- The customer can pay by instant bank transfer, credit card and PayPal. The prices in the webshop are inclusive of VAT. For customers with residence and company headquarters in Switzerland, up to an amount of CHF 200.- can also be purchased on account.
- The purchase price and shipping costs are due immediately and without deduction upon completion of the order. For orders on account, there is a payment period of 20 days from the order date. The prices at the time of the order are always valid
- The purchaser is not entitled to set off his own claims against payment claims of Tropical Mountains.
Shipping and delivery
- As a rule, Tropical Mountains ships orders on the next working day, at the latest on the second working day after dispatch of the order confirmation. Unless otherwise agreed, deliveries in Switzerland and Germany are made to the delivery address provided by the customer, normally within 2 to 3 working days. Deliveries to other EU countries may take longer. In case of any changes regarding the order, you will be informed by email within 5 working days.
- Shipping costs will be added to the listed product prices. The listed shipping costs and allowances remain valid until new conditions are published.

Retention of title
The goods remain the property of Tropical Mountains until full payment has been received.
Defect
Liability
For all defects of the purchased goods occurring during the legal warranty period, instead of legal claims, only the right to repair and remedy of defects during a period of 2 years shall apply. There is no right to withdraw from the contract. There is no money back guarantee.
If it can be proven that the product has not been handled with care, the warranty is void. Tropical Mountains assumes no liability in case of product shipments that are not delivered or are delivered late, due to shipping addresses that were not provided correctly by the purchaser or were not provided at all, customs and export problems or events that can be attributed to force majeure. Tropical Mountains is not responsible for any damages or viruses caused by accessing our website. Return shipping costs are the responsibility of the buyer.
Compostability
Transport damage
If orders are delivered with visible transport damage, this should be reported immediately to Tropical Mountains at info@tropicalmountains.com.

Applicable law and jurisdiction
Swiss law applies exclusively to all disputes arising from the contract. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply. Between merchants and Tropical Mountains, Zug is the exclusive place of jurisdiction.
